These Terms of Use ("Terms") constitute a legally binding agreement between you and MathPop Technologies ("MathPop," "we," "our," or "us") governing your access to and use of the MathPop mobile application, website at mathpop.xyz, and related services (collectively, the "Service").
By downloading, installing, or using MathPop, you agree to these Terms. If you do not agree, do not use the Service. If you are a parent or legal guardian accepting these Terms on behalf of a child, you represent that you have authority to bind the child and yourself to these Terms.
Subject to your compliance with these Terms, MathPop grants you a limited, non-exclusive, non-transferable, revocable license to download and use the MathPop app on Apple-branded devices that you own or control, solely for personal, non-commercial, educational use within your household.
You may not:
MathPop Scholar is offered through auto-renewable subscriptions and a one-time lifetime purchase. Payment is charged to your Apple ID account at confirmation of purchase.
Available plans:
Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Free trial: If offered, any unused portion of a free trial is forfeited when you purchase a subscription. Trial eligibility is determined by Apple and may vary.
Managing subscriptions:You can manage or cancel subscriptions at any time in your device's Settings → Apple ID → Subscriptions. Deleting the app does not cancel your subscription.
Refunds:All purchases are processed by Apple. Refund requests must be submitted directly to Apple in accordance with Apple's refund policies.
MathPop is designed for use by children under parental supervision. Parents and guardians are responsible for:
MathPop does not replace parental judgment regarding screen time, device access, or educational goals.
MathPop provides math practice activities aligned to general K–6 skill levels. The Service is an educational supplement, not a substitute for formal schooling, tutoring, or curriculum prescribed by educators. We do not guarantee specific academic outcomes, grade improvements, or test score results.
All content, design, graphics, logos, software, and materials within MathPop are owned by MathPop Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use MathPop branding without prior written consent.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information — including our COPPA-compliant practices for children. By using MathPop, you consent to the practices described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MATHPOP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATHPOP TECHNOLOGIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MATHPOP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using MathPop at any time by uninstalling the app and canceling any active subscriptions through Apple. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last Updated" date. Material changes will be communicated through the app or via the email associated with your Parent Gateway account. Continued use after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
If you downloaded MathPop from the Apple App Store, you acknowledge that these Terms are between you and MathPop Technologies only, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
